This paper describes the Eunomos software, an advanced legal document and knowledge management system, based on legislative XML and ontologies. We describe the challenges of legal research in an increasingly complex, multi-level and multi-lingual world and how the Eunomos software helps users cut through the information overload to get the legal information they need in an organized and structured way and keep track of the state of the relevant law on any given topic. Using NLP tools to semi-automate the lower-skill (...) tasks makes this ambitious project a realistic commercial prospect as it helps keep costs down while at the same time allowing greater coverage. We describe the core system from workflow and technical perspectives, and discuss applications of the system for various user groups. (shrink)

In December 2017, Law 219/2017, ‘Provisions for informed consent and advance directives’, was approved in Italy. The law is the culmination of a year-long process and the subject of heated debate throughout Italian society. Contentious issues are addressed in the law. What emerges clearly are concepts such as quality of life, autonomy, and the right to accept or refuse any medical treatment – concepts that should be part of an optimal relationship between the patient and healthcare professionals. The law maximizes (...) the value of the patient’s time to decide. Every patient is allowed to make choices for the present as well as for the future, conceived as a continuation of the present, and to decide what comes next, based on what he/she already knows. The law identifies three distinct but converging paths towards the affirmation of a care relationship based on reciprocal trust and respect: the possibility to consent to or refuse treatment, the shared care planning, and advance directives. The fundamental point to emerge from the new Italian law is that consensus is an essential connotation of the treatment relationship. Consensus is not limited to the acceptance/rejection of medical treatment but is ongoing. It is projected into the future through shared care planning and advance directives which act as tools for self-determination and the manifestation of the beliefs and preferences of persons unable to express their will. These principles are in line with the idea of appropriate care as evaluated from two different perspectives, one of scientific adequacy and the other commensurate with the individual’s resources, fragility, values, and beliefs. Surely, however, the new law is not the end of the matter on issues such as conscientious objection, which is deeply rooted within the Italian cultural and political debate. In this regard, healthcare institutions and policymakers will be called upon to develop and implement organizational policies aimed at the management of foreseeable conscientious objection in this field. The automated identification of national implementations of European directives by text similarity techniques has shown promising preliminary results. Previous works have proposed and utilized unsupervised lexical and semantic similarity techniques based on vector space models, latent semantic analysis and topic models. However, these techniques were evaluated on a small multilingual corpus of directives and NIMs. In this paper, we utilize word and paragraph embedding models learned by shallow neural networks from a multilingual legal corpus of European directives and national legislation (...) to develop unsupervised semantic similarity systems to identify transpositions. We evaluate these models and compare their results with the previous unsupervised methods on a multilingual test corpus of 43 Directives and their corresponding NIMs. We also develop supervised machine learning models to identify transpositions and compare their performance with different feature sets. This article seeks to address the problem of the ‘resource consumption bottleneck’ of creating legal semantic technologies manually. It describes a semantic role labeling based information extraction system to extract definitions and norms from legislation and represent them as structured norms in legal ontologies. The output is intended to help make laws more accessible, understandable, and searchable in a legal document management system.

This article describes the creation of a lightweight ontology of European Union (EU) criminal procedural rights in judicial cooperation. The ontology is intended to help legal practitioners understand the precise contextual meaning of terms as well as helping to inform the creation of a rule ontology of criminal procedural rights in judicial cooperation. In particular, we started from the problem that directives sometimes do not contain articles dedicated to definitions. This issue provided us with an opportunity to explore a phenomenon (...) typically neglected in the construction of domain-specific legal ontologies. Whether classical definitions are present or absent, laws and legal sources in general are typically peppered with a number of hidden definitions (in the sense that they are not clearly marked out as such) as well as incomplete definitions, which may nevertheless help legal practitioners (and legal reasoning systems) to reason on the basis of analogy or teleology. In this article we describe the theoretical basis for building an analogical lightweight ontology in the framework of an EU project called _CrossJustice_. We present our methodology for collecting the data, extracting the data fields and creating the ontology with WebProtégé, followed by our conclusions and ideas for future work. (shrink)

Nel mio articolo propongo una lettura dei §§ 79-84 della Critica del Giudizio, parte della sezione Metodologia del Giudizio teleologico. Dapprima mi interrogo sul significato di una Methodenlehre del Giudizio teleologico, che rintraccio in un’attività metariflessiva del Giudizio; procedo poi ad una lettura analitica del testo nelle sue varie articolazioni, nella quale passo in rassegna le questioni attinenti alla specificità dello statuto epistemologico della teleologia, alla possibile convivenza tra finalismo e meccanicismo nella scienza della natura, all’origine della vita, allo scopo (...) ultimo della natura e allo scopo finale della creazione; approdo, infine, ad un’interpretazione per cui l’intera teleologia rationis humanae, che si estende dalla teleologia naturale alla teleologia morale passando per l’antropologia e per la filosofia della storia, viene in questa sezione riarticolata intorno ad un nuovo fulcro concettuale di livello trascendentale, che può garantire l’effettivo collegamento tra queste diverse parti della filosofia proprio perché esso non si esercita in forma di dominio legislativo, ma in forma di riflessione sul molteplice empirico e sulla causalità teleologica propria dell’uomo. Questo articolo cerca di chiarire i termini che costituiscono i fondamenti della concezione della vita vegetale elaborata da Gassendi nel Syntagma philosophicum. Nei primi capitoli del quarto libro, intitolato De plantis, della seconda parte di quest’opera, sono contenute alcune considerazioni sulla natura dell’anima vegetale, della sensibilità, delle funzioni organiche e delle qualità delle piante che rappresentano un densissimo capitolo di filosofia naturale passato finora praticamente inosservato fra le pur fitte maglie delle ricerche sull’opera e il pensiero di Gassendi. Il presente (...) articolo dà rilievo ai contenuti di questa parte del Syntagma, connettendoli coerentemente gli uni con gli altri. The present paper focuses on Gassendi’s Syntagma philosophicum botanical life concepts. In particular here will be analyzed the first chapters of the forth book titled De plantis. The latter contains a considerable amount of observation regarding the nature of the so called vegetable soul, the sensibility, the organic function and quality of plants. Despite the large literature on Gassendi such observations have still been not examined accurately. Here has been done the attempt both of bringing into light such concepts and give them a coherent skeleton. (shrink)
